1. Acceptance of Terms

By downloading, installing, or using Speed Tracker (the „App“), you (the „User“) agree to be bound by these Terms of Use (the „Terms“). If you do not agree to these Terms, you must not use or access the App. The App is provided by Moonshot Apps UG (haftungsbeschränkt), Gontardstr. 11, 95445 Bayreuth, Germany („we“, „our“, or „us“).

2. Description of Service

Speed Tracker is a mobile application designed to track driving statistics, including speed, distance, duration, and route information. The App offers the following features:

• Core Features: Local trip tracking, driving statistics, speed monitoring, and route recording.

• Social Features (subscription required): Account creation, trip sharing (with friends or worldwide), user profiles, friend connections, global and country leaderboards, and driver rankings. Social features require an active subscription and a registered account.

3. Eligibility and Age Requirements

3.1 Minimum Age

The App is not intended for children under the age of 13. Where local law requires a higher minimum age, that higher age applies. By using the App, you confirm that you meet the applicable minimum age requirement.

3.2 Parental Consent

If you are under 18 (or the age of majority in your jurisdiction), you must have received consent from a parent or legal guardian to use the App and create an account.

3.3 Lawful Use

The App is intended for use by individuals who are legally permitted to operate a motor vehicle in their jurisdiction. You are solely responsible for ensuring that your use of the App complies with all applicable licensing, traffic, and driving laws in your country or region.

4. User Accounts

4.1 Account Creation

To access social features, you must create an account using Apple Sign-In or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.2 Account Information

You agree to provide accurate information when creating your account. Your display name must not impersonate another person, contain offensive language, or violate any third-party rights.

4.3 Account Deletion

You may delete your account at any time through the App’s account settings. Upon deletion, your profile, shared trips, friend connections, and all associated data will be permanently removed from our servers in accordance with our Privacy Policy.

5. Subscriptions

5.1 Subscription Plans

Social features are available through monthly or yearly auto-renewing subscription plans. Pricing is displayed in the App and may vary by region.

5.2 Payment and Renewal

Subscriptions are billed through Apple’s App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

5.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

5.4 Refunds

Any refunds are handled exclusively by Apple in accordance with Apple’s App Store policies.

5.5 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will not apply until your next renewal period. You will have the opportunity to cancel before the new price takes effect.

6. Acceptable Use

6.1 Permitted Use

You may use the App to:

• Track your personal driving statistics.

• Share anonymized data via Game Center for personal, non-commercial purposes.

• Share trips, connect with friends, and participate in leaderboards through the social features.

• View other users‘ public profiles and shared trip data.

6.2 Prohibited Use

You agree not to:

• Use the App while actively driving. The App is intended for passenger use only.

• Engage in reckless, dangerous, or illegal driving, including the violation of traffic laws or regulations.

• Attempt to manipulate or falsify tracking data, leaderboard rankings, or profile statistics.

• Share trips or data that are fabricated, manipulated, or do not represent actual driving activity.

• Use offensive, abusive, discriminatory, or inappropriate language in your display name.

• Harass, stalk, threaten, or otherwise engage in harmful behavior toward other users.

• Create multiple accounts to manipulate rankings or circumvent enforcement actions.

• Use the App for commercial fleet tracking purposes without explicit permission.

• Reverse engineer, decompile, or modify the App.

• Attempt to gain unauthorized access to other users‘ accounts or data.

• Use the App or its social features to distribute spam, malware, or any harmful content.

7. User Content and Shared Trips

7.1 Ownership

You retain ownership of the trip data you create. By choosing to share a trip publicly or with friends, you grant us a non-exclusive, royalty-free, worldwide license to host, store, reproduce, modify for technical purposes, publicly display, and distribute such content solely as necessary to operate, improve, and moderate the App and its social features. This license terminates when you remove the shared content or delete your account.

7.2 Responsibility

You are solely responsible for the trips and data you share. By sharing a trip, you confirm that the data represents an actual trip and does not violate any laws or third-party rights.

7.3 Removal

You may remove any shared trip at any time through the App. We also reserve the right to remove shared content that violates these Terms.

8. Safety and Driving Responsibility

IMPORTANT SAFETY NOTICE

• Never interact with the App while driving.

• Always obey traffic laws and speed limits.

• Your safety is paramount; focus on safe driving rather than statistics.

• You are solely responsible for your driving behavior.

• The App is not a substitute for attentive, lawful driving.

8.1 No Driving Advice or Reliance

The App does not provide real-time driving advice, alerts, or recommendations, and must not be relied upon for driving decisions. Any display of speed, rankings, or statistics is incidental and for informational and entertainment purposes only. It is not intended to influence driving behavior in any way.

8.2 Leaderboards and Rankings

Leaderboards and rankings are based on historical, user-shared data and are not designed to reward speed, unsafe driving, or rule violations. No prizes, compensation, or real-world benefits are associated with rankings. The display of rankings does not constitute an endorsement of, or incentive for, any particular driving behavior.

8.3 User Responsibility and Liability

You acknowledge that you are solely responsible for your actions while using the App. You agree not to use the App in a manner that could damage, disable, or impair the App, or interfere with any other party’s use. You agree to indemnify and hold Moonshot Apps UG harmless for any claims, damages, or liabilities arising from your actions, including violations of local laws or regulations.

9. Community Guidelines and Moderation

9.1 Standards of Conduct

Users of the social features must treat other users with respect and maintain appropriate conduct at all times. The social features are intended for the enjoyment of the driving community, and all participants are expected to contribute positively.

9.2 Prohibited Content and Behavior

The following are strictly prohibited:

• Manipulating leaderboards, rankings, or statistics through falsified data or technical exploitation.

• Using display names or profile information that are offensive, discriminatory, sexually explicit, or that impersonate other individuals.

• Sending unwanted or harassing friend requests.

• Any behavior intended to bully, intimidate, or harm other users.

9.3 Reporting

Users may report violations of these guidelines by contacting us at the email address provided in Section 24. We review all reports and take appropriate action.

9.4 Enforcement

We reserve the right, but are not obligated, to monitor user activity and shared content. We do not assume any obligation to actively monitor user content or conduct, and our enforcement actions do not create any duty toward users or third parties. If we determine, in our sole discretion, that a user has violated these Terms or community guidelines, we may take action including but not limited to:

• Issuing a warning.

• Removing offending content.

• Temporarily suspending access to social features.

• Permanently terminating the user’s account.

We are not obligated to provide advance notice before taking enforcement action, except where required by applicable law.

10. Data and Privacy

10.1 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, for detailed information on how we collect, use, and store your personal data.

10.2 Local Data Storage

Trip data that is not shared is stored locally on your device. You retain full control over your personal driving data.

10.3 Cloud Data Storage

If you use the social features, account information, shared trip data, profile data, friend connections, and subscription status are stored on our servers using Google Firebase. Details are described in our Privacy Policy.

10.4 Location Data

The App accesses your location services to track driving routes. You can manage your location permissions in the iOS Settings. Location data is processed locally on your device unless you choose to share trips, in which case route data is uploaded to our servers.

10.5 Game Center Integration

Anonymized driving statistics may be shared with other users through Apple’s Game Center. Game Center integration is governed by Apple’s privacy policies, and you can opt out of Game Center sharing at any time.

11. Service Availability

11.1 No Guarantee of Availability

We strive to keep the App and its social features available at all times, but we do not guarantee uninterrupted or error-free service. The App and its features, including social features and leaderboards, are provided on an „as available“ basis.

11.2 Maintenance and Downtime

We may temporarily suspend access to the App or specific features for maintenance, updates, or technical reasons. Where reasonably possible, we will provide advance notice of planned downtime.

11.3 Third-Party Dependencies

The social features depend on third-party infrastructure (Apple services, Google Firebase). Outages or disruptions to these third-party services may affect the availability of the App’s features. We are not liable for disruptions caused by third-party service providers.

11.4 Modification or Discontinuation

We reserve the right to modify, update, redesign, or replace any feature of the App at any time to improve the service, adapt to technical changes, or evolve the product. Such modifications may include changes to the user interface, feature functionality, metrics, leaderboard mechanics, or the addition and removal of individual features. These changes are part of the normal evolution of the App and do not entitle users to a refund, provided the overall nature and value of the subscription service are not materially diminished.

If we permanently discontinue all paid social features during an active subscription period such that the subscription no longer provides meaningful functionality, affected users will be entitled to a pro-rata refund for the remaining subscription period or an equivalent remedy, to the extent required by applicable law. Any refund requests are processed exclusively by Apple in accordance with Apple’s App Store policies.

12. Force Majeure

We are not liable for any failure or delay in performing our obligations resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, governmental actions or orders, network or infrastructure failures, power outages, or third-party service outages.

13. Intellectual Property

13.1 Ownership

Speed Tracker and all associated content, including but not limited to text, graphics, logos, and software, are owned by Moonshot Apps UG and protected by copyright, trademark, and intellectual property laws.

13.2 License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to sublicense, sell, or distribute the App or any of its content.

14. Disclaimers and Limitations

14.1 No Warranty

The App is provided „as is“ and „as available,“ without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

14.2 Accuracy Disclaimer

Speed and distance measurements are estimates. GPS accuracy may vary based on device and environmental conditions. The App is not intended to provide precise measurements. Leaderboard rankings and aggregate statistics are based on user-reported data and may not be perfectly accurate.

14.3 Social Features Disclaimer

We do not verify the accuracy or authenticity of trips shared by users. Rankings, statistics, and leaderboard positions are provided for informational and entertainment purposes only. We are not responsible for the conduct or content of other users.

14.4 Limitation of Liability

To the maximum extent permitted by law, Moonshot Apps UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including, but not limited to:

• Damages resulting from accidents, traffic violations, or any other driving incidents.

• Loss of data, including locally stored or cloud-stored trip data.

• Disruption of social features, leaderboard rankings, or account access.

• Actions or content of other users.

• Service interruptions caused by third-party providers.

In no event shall our total aggregate liability exceed the amount you paid for the App or its subscription in the twelve (12) months preceding the claim.

Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable consumer protection laws.

15. Indemnification

You agree to indemnify, defend, and hold harmless Moonshot Apps UG, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys‘ fees) arising from: your use of the App; your violation of these Terms; the content you share through the App; or the violation of any third-party rights.

This indemnification obligation applies only to the extent permitted by applicable law and does not apply to liability resulting from our intentional misconduct or gross negligence where such exclusion is prohibited.

16. Termination

16.1 Your Rights

You may stop using the App and delete it from your device at any time. You may cancel your subscription and delete your account at any time through the App’s settings.

16.2 Our Rights

We reserve the right to terminate or restrict access to the App or your account if you violate these Terms, community guidelines, or applicable laws. In the event of termination for cause, any refunds are handled exclusively by Apple in accordance with Apple’s App Store policies.

16.3 Effect of Termination

Upon termination, your right to use the App and its social features ceases. Data associated with your account will be handled in accordance with our Privacy Policy.

17. Updates and Modifications

17.1 App Updates

We may periodically update the App to improve functionality, fix issues, or enhance performance. Continued use of the App after updates constitutes your acceptance of the changes.

17.2 Terms Updates

These Terms may be updated periodically. Any material changes will be communicated to you via the App or our website. The „Last Updated“ date at the top of these Terms indicates when the latest changes were made. Continued use of the App after any updates constitutes acceptance of the revised Terms.

18. Geographic Restrictions

The App is intended for use only in regions where the use of driving tracking applications is lawful. You are responsible for ensuring your use of the App complies with local laws and regulations.

19. Third-Party Services

The App integrates with third-party services, including Apple’s Game Center, Apple’s Sign in with Apple, Apple’s StoreKit, Apple’s Core Location, and Google Firebase. Your use of these services is governed by the respective terms and conditions of Apple and Google.

20. Governing Law and Dispute Resolution

20.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. This choice of law does not deprive consumers of mandatory protections afforded by the laws of their country of residence.

20.2 Jurisdiction

For users residing in the European Union, disputes may be brought before the competent courts of your place of residence or the courts of Bayreuth, Germany. For all other users, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bayreuth, Germany.

20.3 EU Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

21. Assignment

We may assign or transfer these Terms, and any rights and obligations hereunder, in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, without requiring your consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moonshot Apps UG with respect to your use of the App, superseding all prior agreements and understandings, whether written or oral.
